All archival photography, historical research monographs, manuscript records, exhibition text, oral histories, taonga documentation, regional collection materials, and other museum content published on this website are the intellectual property of the Society unless otherwise stated in a figure caption, credit line, footnote, or other item-specific notice. Copyright in the source code files comprising this website was assigned to the Society by DigiCraft Labs Limited on handover of the completed website. The Society owns the delivered website code. Standard HTML, CSS, and JavaScript techniques used on this website, including responsive layout methods, grid structures, and common design conventions, are not claimed as proprietary by any party.
These materials are protected under the Copyright Act 1994 and applicable moral rights. Except where permitted by New Zealand law, by an item-specific licence or notice, or with prior written permission from the applicable rights holder, you may not reproduce, distribute, republish, adapt, or commercially exploit material from this website.
3.2 Item-Specific Notices & Third-Party Material
Where a particular image, document, graphic, or other item carries a credit, licence, permission statement, or other rights notice, that item-specific notice applies to that material and takes precedence over the general terms in this section. Some photographic and graphic assets currently used on this website are provided by third parties under their own licence terms. 3.3 Cultural & Historical Material
Some collection material may have cultural significance in addition to its legal copyright status, particularly material relating to Māori taonga, people, places, tikanga, whakapapa, or mātauranga. Where the Society provides cultural-use guidance, a restriction, or an item-specific notice, users are asked to respect that guidance. Copyright permission does not necessarily remove the need to consider appropriate cultural protocols or permissions.
Historical material may also preserve language, descriptions, images, or attitudes from earlier periods that would not necessarily be used today. Where such material is reproduced for historical or research purposes, its inclusion does not necessarily represent the views of the Society.
3.4 Museum, Society & Designer Branding
The names, logos, and other distinctive branding of the Marlborough Museum and Provincial Archives and the Marlborough Historical Society Incorporated must not be copied, altered, or used in a way that suggests endorsement, sponsorship, or an official association without prior written permission from the Society.
The DigiCraft Labs company brand insignia displayed on this website is the intellectual property of DigiCraft Labs Limited and is used with permission. You may not reproduce or reuse that brand insignia for any other purpose without written permission from DigiCraft Labs Limited.
3.5 Permission, Attribution & Copyright Concerns
If you wish to reproduce museum material for a purpose not otherwise permitted by these terms or by an item-specific notice, contact [email protected] and describe the material you wish to use and how you intend to use it. The Society does not require user accounts and does not intentionally collect personal information through this website beyond what you choose to provide or what is reasonably required to respond to you, process a transaction, or operate and secure the website.
5.2 How We Use It
We use personal information only for purposes connected with the reason it was provided, including responding to enquiries, processing donations or orders, administering memberships or related requests, maintaining records required for the Society's charitable and operational purposes, and protecting the security and integrity of the website.
5.3 How We Store It
Contact form submissions are transmitted by FormSubmit and delivered to the Society's email at [email protected]. Order and donation data is managed by PayPal under its own privacy terms. The Society stores enquiry records and transaction records in its internal systems.
5.4 Cookies & Tracking
This website does not set cookies and does not use tracking technologies for advertising or profiling. The Society uses Cloudflare for hosting, security, and content delivery. Cloudflare Web Analytics provides cookieless aggregate statistics. Google Search Console is used to monitor how the site appears in Google Search; it does not collect visitor data or set cookies.
5.5 Server Logs
Cloudflare may record IP addresses in server logs for security, abuse prevention, and operational purposes. These logs are not used by the Society for advertising, behavioural profiling, or personalised marketing.
5.6 Your Rights
Under the Privacy Act 2020, you have the right to request access to personal information the Society holds about you and to request correction of information that is inaccurate. To exercise these rights, contact [email protected].
5.7 Breach Notification
If a privacy breach occurs that is likely to cause serious harm, the Society will notify affected individuals and the Office of the Privacy Commissioner as required by the Privacy Act 2020.
5.8 Retention
The Society keeps personal information only for as long as it is reasonably needed for the purpose for which it was collected, or as required by law or legitimate record-keeping obligations.
5.9 Event Photography & Video
Photographs or video taken at museum events or activities may occasionally be published on this website or on the Society's social media channels for documentary, educational, or promotional purposes. Where the Society arranges photography involving identifiable people, it will handle personal information in accordance with the Privacy Act 2020 and take reasonable steps to obtain permission where appropriate. If you appear in an image or recording published by the Society and have concerns about its use, contact [email protected] so the Society can consider your request.
5.10 Privacy Contact

Ordinary enquiries, personal information, and private correspondence are not treated as material licensed for publication merely because they are sent to the Society.
If you voluntarily provide photographs, documents, stories, research, corrections, recollections, or other material specifically for possible inclusion in the Society's collections, exhibitions, publications, website, social media, educational material, or other museum activities, you retain any copyright you own unless a different arrangement is agreed in writing.
Unless otherwise agreed in writing, by submitting such material for those purposes you grant the Society a non-exclusive, royalty-free licence to store, reproduce, display, publish, and communicate that material in print and digital formats for the Society's charitable, museum, archival, research, educational, and promotional purposes. The Society may make reasonable formatting, accessibility, or editorial adjustments that do not materially misrepresent the contribution.
You must have the right or authority to provide any material you submit for publication or reuse. If material belongs to, depicts, or contains intellectual property or personal information relating to another person, you are responsible for obtaining any permission reasonably required for the intended submission. The Society is not obliged to publish, retain, or use submitted material.
Consumer Guarantees Act 1993
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993. Goods supplied by the Society must be of acceptable quality, fit for purpose, match their description, and be delivered within a reasonable time where the Act applies. Services must be carried out with reasonable care and skill.
Fair Trading Act 1986
The Society does not engage in misleading or deceptive conduct. Product descriptions, prices, and availability are stated accurately to the best of the Society's knowledge.
Payments
All transactions are processed in New Zealand Dollars (NZD). Shop orders and donations are handled via PayPal or bank transfer. Bank transfers for membership subscriptions, donations, and related payments are processed through the Society's SBS Bank account. Where a payment is processed by a third-party provider such as PayPal, that provider's own terms and privacy practices also apply to its service.
Refunds & Returns
If an item you receive is faulty, damaged, or not as described, contact [email protected] to arrange an appropriate remedy. Archival reproduction orders are custom-produced to order and cannot be returned for change of mind, but this does not limit any rights or remedies you may have if the item is faulty, damaged, or does not match your order. Other change-of-mind returns are at the Society's discretion.
Donations
Donations support activities including, but not limited to, collection conservation, building maintenance, and programmes at Marlborough Museum, Brayshaw Heritage Park, and Riverlands Cob Cottage. Donations are generally non-refundable except where an error has occurred or where a refund is otherwise required by law.
This website contains links to third-party websites and services, including social media platforms, Eventfinda, payment services, and other external resources. These links are provided for convenience, reference, or access to services used by the Society.
